TERMS AND CONDITIONS OF THE ONLINE STORE PrimeCaviar Studio by Paulina Rogal
These Terms and Conditions (hereinafter referred to as the “Terms”) define the rules and conditions for using the online store operating at: www.primecaviar.pl ( the "Online Store").
§ 1. General Provisions
1. The owner of the Online Store is Paulina Rogal, an entrepreneur conducting business under the name Paulina Rogal PrimeCaviar, with its registered office at ul. Doliny Narwi 41, 18-400 Zosin, Poland, entered into the Central Register and Information on Economic Activity, NIP: 7182176380, REGON: 543269983, BDO: 000700820 (hereinafter referred to as the “Seller”).
2. These Terms are addressed to both Consumers and Entrepreneurs using the Online Store and define the rules for using the Store and the procedure for concluding Distance Sales Agreements between the Customer and the Seller through the Online Store.
§ 2. Contact with the Seller

§ 3. Technical Requirements
To use the Online Store, the Customer must have:
- a computer, phone, or other device with an internet browser;
- internet access;
- an active email address.
§ 4. Definitions
- Customer – any person using the Online Store in any way.
- Seller – Paulina Rogal.
- Consumer – a natural person entering into an agreement with the Seller within the Online Store, not directly related to their business or professional activity.
- Entrepreneur – a natural or legal person, or an organizational unit with legal
- capacity, conducting business in their own name, using the Online Store.
- Terms – these Terms and Conditions.
- Cart – a component of the Online Store where the Customer specifies order details, such as personal information, quantity of Products, delivery address, billing details, delivery method, and payment option.
- Newsletter – a commercial communication regarding PrimeCaviar, particularly concerning Products, discount codes, and new arrivals.
- Online Store – the online store operated by the Seller at www.primecaviar.pl.
- Products – goods available for purchase in the Online Store.
- Distance Contract – a contract concluded between the Customer and the Seller through the Online Store without the simultaneous physical presence of the parties.
- Order – the Customer’s declaration of intent submitted via the Order Form to conclude a Sales Agreement with the Seller.
- Order Form – an interactive form available in the Online Store enabling order placement and defining delivery and payment details.
- Sales Agreement – a contract for the sale of a Product concluded between the Customer and the Seller via the Online Store. This term also includes service contracts or contracts for specific work, depending on the Product’s nature.
§ 5. Order Placement Rules
1. Before placing an order, the Customer must read these Terms and Conditions.
2. Information about Products in the Online Store does not constitute an offer within the meaning of the Civil Code but an invitation to make offers.
3. By placing an order, the Customer submits an offer to purchase the selected Product. The Sales Agreement is concluded upon the Seller’s confirmation of order acceptance after verifying Product availability.
4. Orders may be placed 24/7, 7 days a week.
5. The Customer may place an order in the Online Store by selecting the Products presented on the Online Store’s website and adding them to the Shopping Cart. After adding the Products to the Shopping Cart and providing the data necessary to complete the order, the Customer confirms the placement of the order by clicking the “ORDER AND PAY” button.
6. The prices of Products available in the Online Store at the time the Customer places an order shall be binding for both the Customer and the Seller.
7. Prices of Products available in the Online Store are stated in Polish zloty (PLN) or in euro (EUR) and are gross prices (the Seller is exempt from VAT pursuant to Article 113(1) of the Polish VAT Act). The currency in which the price of a given Product is expressed is always clearly indicated.
8. Shipping costs are added to the Product price and displayed in the Cart before order confirmation. The amount depends on delivery method, order value, and size.
9. Online payment processing is handled by Stripe.
10. Accepted payment methods:
- traditional bank transfer (before shipment) to the Seller’s account listed on www.primecaviar.pl;
- BLIK payment;
- online payment via quick transfers or card payments through Stripe.
§ 6. Order Fulfillment
1. The Seller confirms order acceptance by email within 5 business days (or up to 10 during promotional periods).
2. If the fulfillment of an order placed by the Customer is not possible due to the unavailability of the Product in stock (e.g. as a result of multiple customers placing orders for the same Product at the same time), the Seller shall inform the Customer thereof within the time limit referred to in section 1 above by sending a message to the e-mail address provided by the Customer. In the event that only some of the Products covered by the order are unavailable, the Customer shall decide whether the order is to be partially fulfilled or cancelled in its entirety.
3. Orders can be changed or canceled before shipment by emailing primecaviar.studio@gmail.com.
4. If payment was made in advance and the order is canceled, the Seller refunds the amount within 5 business days.
5. Products ordered in the Online Store shall be dispatched to the delivery address indicated by the Customer at the time of placing the order within up to 5 business days, or within up to 10 business days in the case of promotional campaigns, calculated from the date on which the Customer is sent the order confirmation confirming acceptance of the order for processing. This period does not include the time required by the courier company to deliver the shipment, which depends on the courier service selected. In exceptional circumstances, such as holiday breaks, periods of increased sales, or other circumstances beyond the Seller’s control, the order fulfillment time may be extended. Information about any planned break in order fulfillment will always be provided on the Online Store’s website.
6. An exception is made for personalized products, i.e., made-to-order products that require individual production. For these products, the estimated time for order fulfillment is provided in their description on the Online Store’s website. In the case of personalized products (made to individual specifications), the Seller reserves the right to minor variations in color or form resulting from the manual production process.
7. Except for Products collected by the Customer in person, an order is considered fulfilled at the moment the shipment is dispatched to the Customer (i.e., handed over to the carrier responsible for delivery). The exact actual delivery time is determined by the carrier.
8. Acceptance of an order for processing is conditional upon prior payment for the ordered Product. If the Customer chooses bank transfer as the payment method, the Seller will accept the order for processing upon receipt of the payment for the ordered Product in PrimeCaviar’s bank account. If the Customer chooses a standard bank transfer, the payment for the order must be made within 1 day from the date the order is placed. In the absence of payment within the aforementioned period, the Agreement shall be deemed not concluded.
9. Delivery of the shipment to the Customer is carried out via courier companies or Poczta Polska. Delivery of the shipment to the Customer, or to a parcel locker or pickup point selected by the Customer, shall be effected on a business day.
10. An attempt to deliver the shipment to the Customer shall be made once. If the Customer is absent at the specified address, they should contact the courier company to arrange for a redelivery. After a second unsuccessful delivery attempt, the Product will be returned to the Seller, and the Customer will be notified via e-mail to the address provided when placing the order. The Seller will contact the Customer to agree whether the order will be cancelled or another delivery attempt will be made.
11. The Seller issues a sales invoice, sent to the Customer’s email address provided in the order.
§ 7. Right of Withdrawal
1. A Customer who is a consumer may withdraw from the Agreement without giving any reason within 14 days from the date the Customer, or a third party indicated by the Customer other than the carrier, takes possession of the Goods, by submitting a statement of withdrawal from the Agreement to the Seller in accordance with Article 27 of the Act of 30 May 2014 on Consumer Rights. To meet this deadline, it is sufficient to send the statement before the expiry of the period. The Customer may submit the statement using the model withdrawal form, which constitutes Annex No. 1 to these Terms and Conditions.
2. In the event of withdrawal from the Agreement as described in section 1 above, the Customer shall return the Product to the Online Store at the following address: ul. Doliny Narwi 41, 18-400 Zosin, Poland, no later than 14 days from the date of withdrawal from the Agreement. To meet this deadline, it is sufficient to send the Product before the expiry of the period. The Customer shall bear the direct costs of returning the Product to the Online Store.
3. The right of withdrawal from the Agreement does not apply to Agreements for the supply of Goods:
- non-prefabricated goods, manufactured according to the specifications of the consumer / privileged entrepreneur, or intended to meet their individual needs (personalized products, i.e., made to order);
- goods that are liable to deteriorate quickly or have a short shelf life (perishable goods);
- goods supplied in a sealed package, if the package has been opened by the Customer, and the goods cannot be returned after opening for reasons of health protection or hygiene (goods sealed for hygienic reasons);
- audio, visual, or computer recordings supplied on a tangible medium (e.g., CD) in a sealed package, if the package has been opened after delivery;
- goods which, after delivery, due to their nature, are inseparably mixed with other items (e.g., building materials once used);
- newspapers, periodicals, or magazines, except for subscription agreements (printed press);
- goods whose price depends on fluctuations in the financial market over which the Seller has no control, and which may occur before the expiry of the withdrawal period;
- alcoholic beverages, the price of which was agreed upon at the time of the sales agreement, the delivery of which can only take place after 30 days, and whose value depends on market fluctuations over which the Seller has no control.
4. The Customer shall be liable for any diminution in the value of the Product resulting from its use in a manner that exceeds what is necessary to establish the nature, characteristics, and functioning of the Product.
5. Refunds (Product price and standard shipping costs) will be made within 14 days of withdrawal, using the same payment method unless otherwise agreed.
6. The Seller may withhold the refund until the returned Product is received or proof of return is provided.
7. The refund shall be made using the same payment method that the Customer used in the original transaction, unless the Customer has explicitly agreed to a different method.
8. The Customer shall be liable for any reduction in the value of the returned Product if, prior to submitting the statement of withdrawal from the Agreement, the Product was used in a manner other than what is necessary to establish its nature, characteristics, and functioning.
§ 8. Complaints
1. The Seller undertakes to deliver the Product to the Customer free from defects.
2. The Seller shall be liable to the Customer if the sold item has a physical or legal defect, in accordance with the provisions of the Act of 23 April 1964 – Civil Code.
3. Complaints regarding non-conformity of the Product with the Agreement may be submitted:
- in writing to ul. Doliny Narwi 41, 18-400 Zosin, Poland, or
- by email to primecaviar.studio@gmail.com
4. The Seller shall examine and respond to a complaint submitted by the Customer promptly, and no later than within 14 days from the date of submission of the complaint, in the form in which it was submitted (in writing or by e-mail).
5. In the event of dissatisfaction with the way the Seller has handled a complaint, a consumer or privileged entrepreneur may, independently of ordinary proceedings before common courts, make use of out-of-court methods for handling complaints and pursuing claims. For this purpose, the Customer may contact the regional inspector of the Trade Inspection with a request for assistance from the local (municipal) consumer ombudsman or a social organization whose statutory tasks include consumer protection; initiate mediation proceedings for amicable settlement of the dispute; or apply to a permanent consumer arbitration court for resolution of a dispute arising from the concluded Agreement.

§ 10. Newsletter
1. Customers may subscribe to the Seller’s Newsletter by providing consent to receive commercial and marketing information electronically.
2. Unsubscribing is possible at any time via:
- the unsubscribe link in each message,
- by emailing the Seller,
- or by changing user account settings.
§ 11. Intellectual Property Rights
1. Products offered by the Seller constitute intellectual property protected under copyright law.
2. PrimeCaviar holds copyrights or licenses to all images and content on the website. Copying or distributing them without consent is prohibited.
3. Product names may be protected under the Industrial Property Law Act of 30 June 2000.
4. Any unauthorized use of the Store’s content constitutes a copyright infringement and may result in civil or criminal liability.
5. Matters not regulated herein are governed by the Copyright and Related Rights Act of 4 February 1994 (Journal of Laws 2021, item 1062, as amended).
§ 12. Final Provisions
1. The Agreements concluded in the Online Store are governed by Polish law. The Agreement is concluded in the Polish language.
2. None of the provisions of these Terms and Conditions shall exclude or in any way limit the rights of the consumer (or privileged entrepreneur) arising from legal regulations.
3. The Seller reserves the right to amend the Terms and Conditions for important reasons, including, in particular, changes in legal regulations. Orders accepted for processing before the amendments come into effect shall be fulfilled under the previous terms.
4. The Seller is obliged to notify the Customer of any changes to these Terms and Conditions.
5. All amendments to the Terms and Conditions shall come into force on the date specified by the Seller.
6. The amended Terms and Conditions shall be binding on the Buyer/Customer if the requirements set out in Articles 384 and 384[1] of the Civil Code are met, i.e., the Customer has been properly notified of the changes and has not terminated the Agreement within 14 calendar days from the date of notification.
7. For matters not regulated by these Terms and Conditions, generally applicable provisions of law shall apply, including, in particular, the Act of 23 April 1964 – Civil Code, the Act of 30 May 2014 on Consumer Rights, and the European Union General Data Protection Regulation 2016/679 of 27 April 2016 (GDPR).
8. These Terms and Conditions shall apply from 1 January 2026.
